Terms of Service

These Terms of Service (the "Terms") govern your use of Targhee ​ (the "Service"), provided by Targhee Security ("Targhee Security", "we", "us"). By creating an account or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. The Service

Targhee ​ helps security and GRC teams ingest vendor security questionnaires, draft answers using AI grounded in your knowledge base, and route them through a reviewer workflow. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with the plan you have selected.

2. Accounts

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • use the Service unlawfully, fraudulently, or to send spam;
  • infringe the intellectual property or privacy rights of others;
  • upload malware or attempt to probe, scan, or compromise the Service;
  • scrape, reverse engineer, resell, or redistribute the Service;
  • use the Service to generate content that is illegal, deceptive, hateful, or that produces deepfakes or other harmful material;
  • circumvent any technical limits, including plan quotas or rate limits.

4. AI-generated content

The Service uses AI to draft questionnaire responses based on your knowledge base and prompts. AI outputs may be inaccurate or incomplete and are not a substitute for professional security, legal, or compliance advice. You are responsible for reviewing all AI-generated answers before submitting them to a third party and for ensuring that your knowledge-base inputs do not infringe the rights of others. We may filter or refuse outputs and may suspend accounts that misuse the AI features. To request takedown of allegedly infringing material, contact us at legal@targheesecurity.com.

5. Your content

You retain ownership of the policies, questionnaires, and other materials you upload ("Customer Content"). You grant us a limited license to host, process, and transmit Customer Content solely to provide the Service to you.

6. Our intellectual property

We and our licensors retain all rights in the Service, including the software, models, documentation, and branding. No rights are granted except those expressly stated in these Terms.

7. Payments, subscriptions, and Merchant of Record

Our order process is conducted by our online reseller Stripe. Stripe is the Merchant of Record for all our orders. Stripe provides all customer service inquiries and handles returns. Payment, billing, taxes, currency, invoicing, cancellations, and refund mechanics are governed by the Stripe Consumer Terms and Stripe's legal policies, in addition to our own Refund Policy.

Paid plans renew monthly at the price shown at checkout until cancelled. You may cancel at any time from your billing settings; access continues through the end of the current paid period and the plan then reverts to the Free tier.

8. Service availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or always available. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends and we may delete Customer Content after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is capped at the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded by law.

11. Indemnity

You will indemnify us against third-party claims arising from your Customer Content, your use of AI outputs, or your breach of these Terms.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email; continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which Targhee Security is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction.
